These Terms of Service are effective as of September 9, 2025.
The following Terms of Service govern Faklaze's relationship with respect to your use of our game and related services. Use of the Game will also be subject to our Privacy Policy.
Before accessing or using the Game, you must accept these Terms of Service and the Privacy Policy. You may be required to create an account to use the Game. By using or registering for an Account or using the Game, you represent that you are of legal majority in your country of residence. If not, your legal guardian must review and agree to these Terms of Service.
By installing, using or otherwise accessing the Game, you agree to these Terms of Service. If you do not accept these Terms of Service, please refrain from installing, using or accessing the Game in any way. The Game Service will be void in those areas where it is prohibited.
Faklaze reserves the right, at its discretion, to change, modify, add or remove portions of these Terms of Service and our Privacy Policy, as well as other relevant policies, at any time. You are deemed to have accepted these changes by continuing to use the Game. If at any time you do not agree with any part of the current version of our Terms of Service, the Faklaze Privacy Policy or any other policy, your right to use the Game will terminate immediately and you must refrain from using the Game immediately.
1. Use of the Game
Subject to compliance with the conditions set forth herein and other relevant policies of Faklaze, you are granted a limited, revocable right to access the Service. This non-exclusive and non-transferable right is intended solely for your personal, non-commercial entertainment. You are expected to use the Service exclusively for this purpose, agreeing not to use it for any other purpose.
2. Account Creation
During the Registration process, you will be asked to choose a unique password or use other login credentials to access your account. It is essential that you keep this information confidential and do not share it with third parties, as it could compromise the security of your account.
In case of suspicion or knowledge of any security incident, such as loss, theft or unauthorized disclosure of your credentials, we recommend that you notify Faklaze immediately via email faklazeassistant@gmail.com and proceed to change your login information. session. 3. Use Restrictions
By using our Game, you agree to the following restrictions:
(a) Responsible Use: You are responsible for any unauthorized use of the game by minors and must ensure that you adequately supervise their access to it.
(b) Account Integrity: You must not buy, sell, rent or disclose your account, or attempt to create a false account or act on behalf of another person. Additionally, you agree not to share your login information with third parties.
(c) In-Game Purchases: In-game purchases are for in-game use only and have no monetary value outside of the game. You agree that in-game purchases are made solely for the purpose of enhancing your gaming experience and cannot be exchanged for real money or any other item of value.
(d) Unauthorized Modifications: You must not modify or attempt to modify the game in any way, including altering files or using unauthorized third-party software.
(e) Proper Use: You agree to use the game appropriately and in accordance with its entertainment purpose. This includes refraining from any action that may interfere with other users' enjoyment of the game.
Faklaze reserves the right to determine what behavior violates these restrictions and take appropriate action, which may include terminating your account and prohibiting you from accessing the Service.
4. Suspension and Termination of Account and Service
Faklaze reserves the right to limit, suspend, terminate, modify or eliminate accounts or access to the Service, with or without notice, in the event of breach of these Terms of Service or for actual or alleged illegal or inappropriate use of the Service.
In the event of account termination or limitation, you may lose your username, characters, and any benefits associated with the use of the Service, without the right to compensation.
Faklaze also reserves the right to suspend or terminate the Service at any time, without obligation to refund or compensate affected users. Users can terminate their accounts at any time by following the in-Game deletion process.
5. Ownership
(a) Games and Service: All rights related to the Service are the exclusive property of Faklaze, including games, computer code, graphics, story, character design, sounds, and other associated elements. Faklaze reserves all rights, including intellectual property rights, in its games and the Service.
(b) Accounts: Without prejudice to the provisions of these terms, you acknowledge that you have no ownership or right over the Account, which is and will remain the property of Faklaze at all times.
(c) Virtual Content: Faklaze owns and has the right to use all content present on the Service or in Faklaze games. You agree that you do not own any rights to such content.
6. User Content
(a) Submission of User Content: Any material you share through the Service, such as text or images, must be accurate and not violate the rights of third parties. Faklaze reserves the right to monitor and remove inappropriate content.
(b) Content Filtering: Faklaze is not responsible for content generated by users. You accept the risks associated with the use of the Service and any content to which you may be exposed.
(c) Use of Information by Other Members of the Service: You are responsible for the information you post on the Service and Faklaze reserves the right to remove any content it deems inappropriate.
By using the Service, you grant Faklaze a license to use and exploit your user content for various purposes, including marketing of the Service.
You are responsible for your interactions with other users and parties through the Service.
Faklaze reserves the right to intervene in disputes, but has no obligation to do so. You release Faklaze from any claims arising from such disputes.
7. Rates and Purchase Conditions
(a) Purchases: In Faklaze, you have the option to purchase, with real money, various Virtual Items to use in the Games. These include virtual currency, in-game items, and other digital products or services. Purchases can only be made through authorized partners.
(b) Purchase and Sale Agreement: By making a purchase, you agree that the purchase and sale agreement will be formalized before the legal withdrawal period established by the applicable laws expires. You waive your legal right of withdrawal and consent to receive the content immediately.
(c) Management of Virtual Objects: Faklaze reserves the right to manage, regulate, control, modify or delete Virtual Objects at any time, without prior notice. Transfers of Virtual Items are not permitted unless expressly authorized in the Service.
(d) Final Purchase: All purchases of Virtual Items are final and non-refundable, unless required by applicable law. Faklaze is under no obligation to provide refunds for any reason.
(e) Payment of Fees: You agree to pay all applicable fees and taxes. Faklaze reserves the right to revise prices at any time and will not issue refunds for unused Virtual Items in the event of account closure.
8. Service Updates
The Faklaze Service and Games may be updated periodically, and you may be required to accept these updates. You acknowledge and agree that Faklaze may update the Service and the games with or without notice. You may need to update third-party software to receive these updates.
9. Exclusion of Guarantees
Without limiting Faklaze's liability and to the maximum extent permitted by applicable law, the Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including, but not limited to, warranties of commerciality, fitness for a particular purpose, ownership and non-infringement. Faklaze does not warrant that the Service will always be available, error-free, or free of viruses or other harmful components.
10. Limitation of Liability
Faklaze will not be liable to you for any indirect, incidental, consequential, special, punitive or other damages, including loss of revenue, lost profits, loss of data or business interruption, whether based in contract, unlawful act or any other legal theory. Faklaze's maximum liability will be limited to the amount it has paid in the six months immediately preceding the first claim. If you have not made in-game purchases within this time, the only solution for any conflict with Faklaze will be for you to stop using the Faklaze Services and delete your Account.
You agree to indemnify, defend and hold Faklaze and its affiliates harmless from any claim, demand or loss arising from your use of the Service or your breach of these Terms of Service, unless the violation is not attributable to your intentional or negligent behavior.
11. Conflict Resolution
You and Faklaze each agree that any dispute related to the Terms of Service, the Privacy Policy or the Service will be resolved through the dispute resolution processes specified in this agreement, including legal, equitable or statutory claims, even if you stop using your Account. or the Service. These processes will also apply to conflicts that arose before the signing of this agreement.
12. Applicable Legislation
You agree that any dispute arising out of the Terms of Service, the Privacy Policy or the Service will be subject to the laws of Peru, without regard to its conflict of law provisions.
13. Jurisdiction for Resolution of Conflicts Not Subject to Arbitration
You agree that any claim or dispute against Faklaze must be resolved exclusively by a court in Peru.
14. Divisibility
You and Faklaze agree that if any part of the Terms of Service or the Privacy Policy is determined by a court in competent jurisdiction to be illegal or unenforceable, such provision will be effective only to the extent determined by the illegality or unenforceability, without affecting the validity and applicability of the other provisions in any other jurisdiction. The remaining provisions of these Terms will remain valid and effective.
15. General Provisions
(a) Assignment: We reserve the right to assign or delegate these Terms of Service or our Privacy Policy, in whole or in part, to any person or entity at any time, with or without your consent. However, you may not assign or delegate any rights or obligations without our prior written consent.
(b) Supplementary Policies: We may establish additional policies related to specific services, such as forums, contests or programs. Your access and use of these services will be subject to both these specific policies and the Terms of Service set forth herein.
(c) Entire Agreement: These Terms of Service, together with any additional policies, constitute the entire agreement between you and Faklaze, superseding any prior agreements on the same subject matter.
(d) No Waiver: Our failure to enforce strict performance of any provision or right shall not constitute a waiver of such right or provision, nor shall it affect our ability to enforce such right or provision in the future. Furthermore, no waiver of any specific provision will be deemed a waiver of any other provisions or rights.
(e) Notifications: Any notifications we need to make will be made through our games, our official website, newsletter, email or other means of communication provided by you. All notices required by you in relation to these Terms must be in writing and sent to the specified address.
(f) Injunctive Relief: You acknowledge that any breach of these Terms by you would cause irreparable harm to Faklaze, and we reserve the right to seek injunctive or other remedies in the event of breach by you.
(g) Force Majeure: We will not be responsible for any failure or delay due to circumstances beyond our reasonable control, such as acts of God, war, terrorism, natural disasters, government actions, among others.
